PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP

Hiking, kayaking, boating, snowshoeing, snowmobiling, atving and camping are potentially dangerous activities. HC Maine Adventures LLC adheres to the highest safety and training standards but there are inherent risks, which we cannot control and cannot be eliminated as possible scenarios.

(The participant or parent of a minor) hereby acknowledge the following:

This trip offered by HC Maine Adventures LLC [hereinafter known as Releases] may take place in a remote wilderness setting and involve activities with numerous inherent risks from travel by canoe, kayak or by foot (hiking, snowshoeing) in a remote wilderness setting and exposure to potentially dangerous animals or plants. Such risks may result in significant injury including but not limited to: death, the potential for permanent paralysis, drowning, bodily injury, sunburn, dehydration, insect or animal bites, encounters with wildlife, and other harm which may be encountered by wading, boating, recreational sports and those activities associated with. In the event of an injury or illness medical facilities may be several hours and in extreme cases, possibly days away from remote settings and evacuation may be required by helicopter, airplane, etc. Participants are responsible for any additional costs incurred for evacuation as the result of injuries or illness. Travel may include the use of charter planes. I expressly agree, and promise to accept and assume all responsibilities and risk of injury, death, illness or disease, or damage to myself, to others, or to my property, arising from my participation in this activity. In signing this document, I fully recognize that if anyone is hurt or property is damaged while I engage in this event, I will have no right to make claim or file a lawsuit against HC Maine Adventures LLC or its officers, agents, contractors, or employees.

I agree to follow the instructions of the trip leader and will bring to that leader’s attention any unusual significant hazard that I observe. I will take steps to avoid such hazard. I recognize the danger of being under the influence of substances while participating in these activities and will refrain from using any substances in a manner that would affect my ability to respond to these inherent dangers.

PHYSICAL HEALTH: To the best of my knowledge I, the client, have no physical restrictions which would prohibit my participation in any-and-all activities offered by HC Maine Adventures, including hiking, boating, boarding or disembarking the vessel, or consuming food or beverage prepared by the outfitter or their representatives. I certify that I have sufficient health, accident, and liability insurance to cover any bodily injury or property damage I may incur while participating in this event and to cover bodily injury or property damage caused to a third party as a result of my participation in this event. If I have no insurance, I certify that I am capable of personally paying for any and all such expenses or liabilities. Should emergency medical services become necessary to me or any minor I have authorized to participate, I agree that I will not hold HC Maine Adventures LLC liable regarding the provision of medical and/or emergency care or the adequacy of any such care. HC Maine Adventures LLC reserves the right to decline service to any person it judges incapable of meeting the requirements of participating in recreational related activities. 

 

PERSONAL FLOATATION DEVICES/LIFE JACKETS: I acknowledge that HC Maine Adventures LLC will provide life jackets for me and any minor accompanying me and I/we are advised to wear it at all times while on the vessel, at the marina or launch area, or when otherwise instructed to do so. Failure to do so is at my/our own risk. In a motor boat under power, appropriate PFD must be worn at all times without exception.

Release and acknowledgement of risk: I also understand that there are potential risks of which I may not presently be aware. Because of the dangers of participating in this activity, I recognize the importance and agree to fully comply with the applicable laws, policies, rules,and regulations, and any guide’s instructions regarding participation in this activity. I understand that the HC Maine Adventures LLC (guide service) does not insure participants in the above-described activity, that any coverage would be through personal insurance, and the Guide Service has no responsibility or liability for injury resulting from this activity. I voluntarily elect to participate in this activity with knowledge of the danger involved, and I hereby agree to accept and assume any and all risks of property damage, personal injury, or death.

 

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, Except for gross negligence on the part of HC Maine Adventures LLC and its agents, and assume full responsibility for my participation in such inherently risky activities. 

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS HC Maine Adventures LLC., its trip leaders and other agents and/or employees, from any and all claims, demands, losses, and liability arising out of or related to any INJURY, DISABILITY OR DEATH I may suffer, or loss or damage to person or property, WHETHER ARISING FROM ANY NEGLIGENCE, ACT OR OMISSION OF THE RELEASEES, to the fullest extent permitted by the laws of the State of Maine. 

HC Maine Adventures LLC cannot be held responsible for any inconvenience, damage, delay caused by late departure, weather, water levels, itinerary changes, etc. All deposits on trips are non-refundable. We recommend that participants consider travel insurance for financial protection in case of flight delay or cancellation, lost or delayed luggage, or personal medical needs or emergency while on a trip. You can compare various insurance options on the website: https://www.squaremouth.com/ If cancelled within 72 hours before the adventure and is paid in full, the balance can be used towards a future adventure with HC Maine Adventures LLC.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I FURTHER ACKNOWLEDGE THAT PARTICIPATION IN THIS TRIP IS A VOLUNTARY ACTIVITY AND NEITHER A PUBLIC SERVICE NOR A PRACTICAL NECESSITY AND I AM FREE TO DECLINE TO PARTICIPATE.
